This study conducted an audit of two reporting mechanisms for non-consensual intimate media (NCIM) on the social media platform X (formerly Twitter). The researchers created 50 AI-generated nude images depicting fictional personas and reported half of the images under X's "non-consensual nudity" policy and the other half under the "copyright infringement" (DMCA) mechanism.
The key findings are:
- DMCA reports led to successful removal of all 25 images within 25 hours, with a 100% removal rate.
- In contrast, none of the 25 images reported under the non-consensual nudity policy were removed over the 3-week observation period, resulting in a 0% removal rate.
- Accounts that posted images reported under the DMCA faced temporary suspensions, while accounts in the non-consensual nudity condition faced no consequences.
- The posted images received negligible views and engagement across both conditions.
These results highlight the stark contrast between the effectiveness of the DMCA, which is backed by federal legislation, versus X's internal non-consensual nudity policy, which lacks external enforcement. The findings underscore the need for targeted legislation to regulate the removal of non-consensual intimate media online, rather than relying solely on platform goodwill.
The researchers also discuss the ethical considerations involved in conducting this audit study, including the creation and posting of deepfake nude content, as well as the use of the DMCA outside of its intended commercial purpose.
